Terms of Service
These Terms of Service (“Terms”) govern your access to and use of the website at helpwithoutsurgery.com (the “Site”), operated by IDK Strategies LLC, DBA Regenerative Atlas (“Regenerative Atlas,” “we,” “us,” or “our”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
What the Site is
The Site provides educational information and a way to request a free consultation with the medical practice of James C. Padula, DO. The Site is a marketing and intake service. It does not provide medical advice, diagnosis, or treatment, and using the Site does not create a doctor–patient relationship. A doctor–patient relationship is formed only after an in-person evaluation by a licensed physician. If you are experiencing a medical emergency, call 911 or go to the nearest emergency room — do not use this Site.
Eligibility
You must be at least 18 years old and able to form a binding contract to use the Site.
Your responsibilities
- Provide accurate information and keep your contact details current.
- Use the Site lawfully and not to disrupt, harm, or misuse it.
- Not submit another person's information without their permission.
Communications consent
By submitting a form, you agree we may contact you about your request by email and phone. Some of our forms separately ask for SMS consent in two independent categories: appointment & service texts (confirmations, reminders, and follow-ups related to your request) and marketing & promotional texts (offers and updates). Each is optional, neither is a condition of any purchase, and declining or later revoking one does not affect the other. For either, message frequency varies, message and data rates may apply, reply STOP to opt out and HELP for help, and carriers are not liable for delayed or undelivered messages. No medical guarantees
Regenerative therapies are not FDA-approved to diagnose, treat, cure, or prevent any disease, and individual results vary. Nothing on the Site is a guarantee of any outcome. Candidacy and pricing are determined only after a physician reviews your imaging. See our Medical Disclaimer.
Intellectual property
The Site and its content, logos, and design are owned by us or our licensors and are protected by law. You may not copy, reproduce, or create derivative works without our permission.
Disclaimers & limitation of liability
The Site is provided “as is” without warranties of any kind. To the fullest extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the Site.
Indemnification
You agree to indemnify and hold harmless IDK Strategies LLC and the medical practice of James C. Padula, DO from claims arising out of your misuse of the Site or violation of these Terms.
Third-party links
The Site may link to third-party websites and services we do not control and are not responsible for.
Dispute resolution
Before filing a claim, you agree to contact us at hello@helpwithoutsurgery.com so we can try to resolve the issue informally. If we can't resolve it within 30 days, either party may pursue available legal remedies.
Governing law & venue
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any dispute not resolved informally will be brought exclusively in the state or federal courts located in Palm Beach County, Florida.
General
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect. Our failure to enforce any provision is not a waiver of it. You may not assign these Terms without our consent; we may assign them freely. These Terms are the entire agreement between you and us regarding the Site.
Changes
We may update these Terms from time to time. Continued use of the Site after changes constitutes acceptance of the updated Terms.
